NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. BY ENTERING THIS SWEEPSTAKES YOU EXPRESSLY AGREE TO BE SIGNED UP FOR THE SHERWIN-WILLIAMS COMPANY PREFERRED CUSTOMER PROGRAM WITH PAINTPERKS™ BENEFITS (“PROMOTIONAL MATERIALS”). ENTRANTS CAN OPT OUT OF RECEIVING PROMOTIONAL MATERIALS AT ANY TIME BY FOLLOWING THE INSTRUCTIONS FOUND WITHIN THE PROMOTIONAL MATERIALS.
DATES OF SWEEPSTAKES: The Sherwin-Williams Company “The Ultimate Soccer Room” Sweepstakes (the “Sweepstakes”) begins at 12:00 a.m. Eastern Time (“ET”) on June 15, 2014 and ends at 11:59 p.m. ET on August 31, 2014 (the “Sweepstakes Period”).
ELIGIBILITY: The Sweepstakes is open only to legal residents of the fifty (50) United States, the District of Columbia, or Puerto Rico who are at least eighteen (18) years of age or older at the time of entry (the “Entrant”). The Entrant who is selected as the grand prize winner (the “Grand Prize Winner”) must have a unique, personal and valid social security number for Sponsor (defined below) to report the tax liability associated with acceptance of the grand prize (the “Grand Prize”). Valid social security numbers will be determined by Internal Revenue Service (“IRS”) requirements as further defined in the “Prize Claims” section of these Official Rules. Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live) or persons living in same household (whether related or not) of The Sherwin-Williams Company (the “Sponsor”), Sports Endeavors, Inc., and each of their respective parent companies, divisions, affiliates, contractors, subsidiaries, distributors, sales representatives, retailers, advertising and promotion agencies, and any others engaged in the development, production, execution or distribution of this Sweepstakes including, but not limited to National Sweepstakes Company, LLC (the “Independent Administrator”) are not eligible to participate. The Sweepstakes is subject to all federal, state and local laws and regulations and is void where restricted or prohibited by law.
TO ENTER: There are two (2) ways to earn Entries into the Sweepstakes as further described below; (a) the initial entry (“Initial Entry”); and (b) bonus entries (each, a “Bonus Entry”). All Entrants must first obtain an Initial Entry into the Sweepstakes prior to earning Bonus Entries.
Initial Entry (Required): Limit of one (1) Initial Entry per person during the Sweepstakes Period. Visit miscolor.es/SWSoccerRoom (the “Website”) and click on the “Enter Now” button in order to access the official Sweepstakes entry form (“Entry Form”). Then, complete the Entry Form in its entirety by submitting your full name (including your first and last name), email address, home address, city, state, zip code and date of birth. Upon clicking the “Enter Sweepstakes” button, Entrants will receive one (1) Initial Entry into the Sweepstakes. The maximum number of Initial Entries an Entrant can receive is one (1).
Bonus Entries (Optional): There are two (2) ways to earn Bonus Entries into the Sweepstakes as outlined below. Regardless of the method(s) used to obtain Bonus Entries into the Sweepstakes, the maximum number of Bonus Entries an Entrant can receive is five (5).
(a) Sharing the Sweepstakes via Social Networks:
• Facebook® “Like” and Pinterest “Share”: If desired, after clicking the “Enter Sweepstakes” button (outlined above), click the applicable icon/button to either “Pin” or “Like” your favorite room photograph (“Photo”) to your Pinterest profile or Facebook® page. Then, click the “Continue” button.
• Recommend/Share on Facebook®: If desired, click the “Recommend” or “Share” icon/button to recommend or share the Sweepstakes on your Facebook® page.
• Recommend/Share on Twitter®: If desired, click the “Tweet” icon/button to share the Sweepstakes on your Twitter® page.
• Share the Special Link: If desired, copy, paste and share the unique URL (provided on the confirmation page) in any way you wish (including personal blog posts and other social networks).
Entrants will receive one (1) Bonus Entry into the Sweepstakes each time a referred friend (the “Friend”) either; (a) enters the Sweepstakes via the Facebook® “Like”; (b) enters the Sweepstakes via the Pinterest “share”; (c) enters the Sweepstakes via a Facebook® “Recommendation” or “Share”; (d) enters the Sweepstakes via the Twitter® “share”; or (e) enters the Sweepstakes via the Sweepstakes link. The maximum number of Bonus Entries an Entrant can receive is five (5).
IMPORTANT: IN ORDER TO RECEIVE BONUS ENTRIES, THE FRIEND(S) WHO LEARNED OF THE SWEEPSTAKES VIA ANY OF THE SOCIAL NETWORK REFERRALS LISTED ABOVE MUST ENTER THE SWEEPSTAKES BY FOLLOWING THE STEPS TO RECEIVE AN INITIAL ENTRY. IF A REFERRED FRIEND DOES NOT ENTER THE SWEEPSTAKES BY FOLLOWING THE STEPS TO RECEIVE AN INITIAL ENTRY, NO BONUS ENTRIES WILL BE AWARDED TO YOU FOR THAT FRIEND.
(b) Without Sharing the Sweepstakes via Social Networks: To receive Bonus Entries into the Sweepstakes without sharing the Sweepstakes via social networks, visit miscolor.es/SoccerRoomAMOE and complete the Bonus Entry Form in its entirety including your first name, last name, address, city, state, zip code, telephone number, date of birth, and email address. The press the “Submit” button in order to receive one (1) Bonus Entry into the Sweepstakes. The maximum number of Bonus Entries an Entrant can receive into the Grand Prize drawing is five (5).
The use of any agencies or automated software to submit Entries will void all Entries submitted by that person. Any attempt by an Entrant to obtain more than the stated number of Entries by using multiple/different identities, and/or any other methods will void that Entrant’s Entry and that Entrant may be disqualified from the Sweepstakes. In the event of a dispute regarding the identity of the person submitting an Initial Entry the entry will be deemed submitted by the person in whose name the email account (provided at time of entry) is registered (“Authorized Account Holder”).The Authorized Account Holder is the natural person who is assigned to the email account by an entity responsible for assigning email addresses. Potential Prize Winners (defined below) may be required to show proof of being the Authorized Account Holder. No mechanically or programmatically reproduced Entries are permitted. Sponsor will not confirm receipt of Entries for Entrants. All Entries submitted become the sole property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, misdirected, illegible, or damaged Entries. By entering, each Entrant; (a) represents that he/she is at least eighteen (18) years of age and otherwise eligible to participate in the Sweepstakes; and (b) fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor, which are final and legally binding in all respects. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook®, Twitter® or Pinterest. Entrants understand that the information being provided at point of entry is being provided to the Sponsor solely, and not to Facebook®, Twitter® or Pinterest.
WINNING: There will be one (1) drawing held on or about September 5, 2014. For the drawing, one (1) Grand Prize Winner and two (2) first prize winners (each, a “First Prize Winner”) will be selected at random from among all eligible Entries received during the Sweepstakes Period. For purposes of these Official Rules, the Grand Prize Winner and First Prize Winner will be collectively referred to as “Prize Winners”. Odds of being selected as a Prize Winner depend upon the total number of eligible Entries received during the Sweepstakes Period. The random drawing will be conducted by the Independent Administrator whose decisions are based upon their sole discretion and interpretation of these Official Rules and are final and binding in all respects.
NOTIFICATION: The First Prize Winners will be notified upon receipt of their respective Prize within six (6) to eight (8) weeks from the random drawing. In the event a First Prize (defined below) is returned as “Undeliverable”, the respective potential First Prize Winner will be disqualified and an alternate First Prize Winner will be selected at random from among the remaining non-winning eligible entries received during the Sweepstakes Period. The potential Grand Prize Winner will be notified by email immediately following the random drawing and will be required to complete and return “Required Documents” within seven (7) business days as further described in the “Prize Claims” section below. Independent Administrator will make two (2) attempts to reach the potential Grand Prize Winner via email as noted in the “Prize Claims” section below. In the event the Independent Administrator cannot reach the potential Grand Prize Winner via email after two (2) attempts, or if it is determined by Independent Administrator, in its sole discretion, that the potential Grand Prize Winner is not eligible in accordance with these Official Rules, an alternate Grand Prize Winner will be selected at random from among all remaining non-winning eligible entries received during the Sweepstakes Period. In such case, the alternate Grand Prize Winner will be notified as outlined above and as further described in the “Prize Claims” section below.
PRIZES:
Grand Prize: One (1) Grand Prize will be awarded to the Grand Prize Winner inclusive of; (a) one (1) $500 The Sherwin-Williams Company gift card; (b) one (1) $500 VISA® gift card; and (c) $1,000 worth of soccer.com gift cards (provided to Grand Prize Winner in the form of ten (10) $100 soccer.com gift cards). The approximate retail value (“ARV”) of the Grand Prize is $2,000.
First Prizes: One (1) first prize (“First Prize”) of a $250 The Sherwin-Williams Company gift card will be awarded to the first First Prize Winner selected in the drawing. The second First Prize Winner selected in the drawing will receive $250 worth of soccer.com gift cards (provided to First Prize Winner in the form of two (2) $100 soccer.com gift cards and one (1) $50 soccer.com gift card). The ARV of each First Prize is $250.00. A total of two (2) First Prizes will be awarded in the Sweepstakes. The total ARV of all First Prizes to be awarded is $500.
The total ARV of all Prizes to be awarded in the Sweepstakes is: $2,500. Gift Cards are subject to individual gift card terms and conditions. No substitution or cash alternative will be provided for any Prize. Sponsor will not replace a lost, mutilated or stolen Prize. Sponsor reserves the right to substitute a Prize with a prize of comparable or greater value if Prize should become unavailable for any reason. Prize is not transferable prior to award. The Prizes consist only of the items specifically listed as part of the Prize descriptions. Prize Winners agree that the Prizes are being provided “as is”, and the Released Parties (as defined in the “RELEASE” section below) make no warranty, representation or guarantee regarding a Prize, including but not limited to its quality, condition, merchantability or fitness for a particular purpose. Prize Winners must look solely to the manufacturer of a Prize for any such warranties or guarantees, if any. Name of prize manufacturers are used solely for the purposes of identification of the Prizes. No endorsement, authorization, sponsorship, or approval of prize manufacturers is intended or implied by such use. The Prize Winners consent (and agree to sign any additional documents required by Sponsor to formalize, effect or perfect such consent, except where prohibited by law) to Sponsor’s use of his/her name, likeness (photograph and/or video), biographical information, and voices in advertising/publicity/trade without compensation, notice or approval; and, each Prize Winner disclaims any ownership rights of such advertising/publicity/trade material (TN residents will not be required to sign a publicity release). No more than the number of Prizes set forth in these Official Rules will be awarded. Limit of one (1) Prize per person/household.
PRIZE CLAIMS: Except where prohibited by law, the potential Grand Prize Winner must sign and return to Sponsor within seven (7) business days of receipt, an Affidavit of Eligibility & Liability/Publicity Release (the “Release”) and an IRS Form W-9 in order to claim his/her Grand Prize (collectively, the “Required Documents”). If the potential Grand Prize Winner fails to return the Required Documents within seven (7) business days of receiving it, potential Grand Prize Winner forfeits his/her right to the Grand Prize and another Grand Prize Winner will be selected at random from among the remaining non-winning eligible entries received during the Sweepstakes Period. At the end of the tax year for which the Grand Prize is awarded, Grand Prize Winner will be issued a Form 1099 equivalent to the retail value of the Grand Prize, for income verification and tax purposes. Grand Prize Winner is advised to seek independent counsel regarding the tax implications of their Grand Prize winnings. Potential Grand Prize Winner must report income to the IRS. In the event it is deemed during the verification process that the potential Grand Prize Winner does not have a unique, personal and valid social security number for Sponsor to report the tax liability associated with acceptance of the Grand Prize, potential Grand Prize Winner will be disqualified and another Grand Prize Winner will be selected from among the remaining non-winning eligible entries received during the Sweepstakes Period. Valid social security numbers will be determined by IRS requirements. If it is determined by the Sponsor, in its sole discretion, that the potential Grand Prize Winner is not eligible in accordance with these Official Rules, the potential Grand Prize Winner forfeits his/her right to the Grand Prize and an alternate may be selected from among the remaining non-winning eligible entries received during the Sweepstakes Period. In the event that the potential Grand Prize Winner is disqualified for any reason, Sponsor and Independent Administrator shall have no liability or obligation to such individual.
GENERAL CONDITIONS: Should any portion of the Sweepstakes be, in Sponsor’s sole discretion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole discretion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes in a manner which in its sole discretion is fair, appropriate and consistent with these Official Rules. Notice of such action by Sponsor will be posted to the Website. In such event, Sponsor reserves the right to award the Prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Sponsor reserves the right to disqualify or reject any incomplete, inaccurate or false entry. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR'S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.
RELEASE: By participating in this Sweepstakes, Entrants agree to release and hold harmless Sponsor, Sports Endeavors, Inc., Facebook, Inc., Twitter, Inc., Pinterest, and each of their respective officers, directors, managers, employees, parents, subsidiaries, affiliates, agents, members, shareholders, insurers, servants, divisions, predecessors, successors, representatives, distributors, advertising, promotion, and fulfillment agencies, including the Independent Administrator, consultants and legal advisors (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt, redemption or use of any Prize.
LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (a); unauthorized human intervention in any part of the entry process or as it pertains to the Sweepstakes; (b) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; (c) any injury or damage to persons or property (including but not limited to Entrant's wireless device, or mobile phone) which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Sweepstakes; (d) any printing or typographical errors in any Sweepstakes-related materials (if applicable); (e) stolen, lost, late, misdirected, corrupted, incomplete, or indecipherable entries or the unavailability or inaccessibility of any transmissions, telephone, wireless device carrier networks or Internet Service (as applicable); (f) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network (including Entrant’s particular wireless device carrier network), hardware or software; (g) Entrant’s inability to connect to his/her particular mobile device carrier network for any reason, including due to poor carrier reception and/or signal strength at any particular location (if applicable); and (h) the unavailability or inaccessibility of any transmissions, telephone, wireless device carrier networks or Internet service. All federal, state and local regulations apply.
ENTRANTS’ PERSONAL INFORMATION: Information collected from Entrants is subject to Sponsor’s Privacy Policy, located at http://www.sherwin-williams.com/privacy/index.jsp.
WINNER’S LIST/OFFICIAL RULES REQUEST: For the name of the Prize Winners or a copy of these Official Rules, please submit a self-addressed, stamped envelope for receipt no later than October 31, 2014 to “The Sherwin-Williams Company The Ultimate Soccer Room Sweepstakes”, PO Box 10505, Rochester, NY 14610. (please specify “Winner’s List” or “Official Rules Request” on the outside of the envelope). Residents of VT may omit return postage.
